Modding is legal in most countries for backups. Downloading paid games you never bought is not.

The Wii U eShop became a haven for indie developers. Games like "OlliOlli," "Abzu," and "The Denpa Men: They Came By Wave" showcased the diversity and creativity of the indie scene. These titles, often characterized by their unique gameplay mechanics, vibrant graphics, and innovative use of the Wii U's GamePad, helped enrich the console's library and appealed to gamers looking for something different.

You cannot buy any new digital games on Wii U. Your only legal sources are pre-owned physical discs and any downloads that came pre-installed on a used console (if the previous owner’s account is still on it – but do not delete it). For most digital exclusives, the Switch has become the modern home.
